MARRIAGE REGISTRATION CONSULTANCY / MARRIAGE CERTIFICATE CONSULTANTS:

There are two marriage registration centres in Mumbai - Bandra and Fort. The Bandra (Suburban Mumbai) office registers all marriages between Sion and Mulund in the central suburbs and Bandra and Dahisar on the western side. The Fort office's (Mumbai City) jurisdiction extends southward from Bandra and Sion.

Q. 1. What is the function of the marriage office?
Ans: There are two marriage offices specifically meant for solemnising marriages; one is in Pune and the other at Mumbai. The Marriage Officer is incharge of the Marriage Office and is of the rank of Sub-Registrar. There are two acts which draw the guidelines regarding solemnising of marriages; they are:
1. Special Marriage Act
2. Bombay Marriage Act

Following points cover Special Marriage Act:
Ans: => Notice period is 30 days and has to be signed by the prospective bridegroom and bride.(validity of notice is 90 days) Support documents required is the proof of age (legal marriageable age for males is 21 years and for females it is 18 years) A fee of Re.1 is taken and notice is displayed for public view.
=> In case of either the bride or bridegroom residing in another jurisdiction, a copy of memorandum is sent to the concerned District Marriage Officer (JDR) for public display.
=> A register of marriage notice is maintained to record the notices.
=> Both the bride and bridegroom have to appear in person in front of the marriage officer between 30 to 90 days after the notice is given alongwith 3 witnesses for getting the marriage solemnised (provided that no objections are raised by anyone).
=> Duplicate copy of marriage certificate can be had by giving an application to the marriage officer. A certificate book is maintained for this.

Following points cover Bombay Marriage Act:
Ans:=> This act legalises marriages performed by priests at any place. => Memorandum is to be filled in duplicate and submitted to the marriage officer after the marriage.
=> A fixed fee of Rs.50 is charged (in the form of court fee stamp) for registering the marriage alongwith a registration fee of Re. 1 (if the memorandum is submitted within 30 days of marriage). It is Rs. 3 if the memorandum is submitted within 30 to 90 days of marriage and Rs.5 if the memorandum is submitted after 120 days of marriage.
=> The memorandum is then pasted in the marriage paste book.
=> *Wherever marriage office is absent, the JDR performs the function of the marriage officer

How to obtain a Marriage Certificate?

A) Marriages to be solemnized under Special Marriage Act. 1954

How to apply?
Applicant has to apply in the prescribed form. The age limit for Bridegroom 21 years and Bride is 18 years.

What documents to attach?
  • Bride and Bridegroom AGE proof (School/College Leaving Certificate or Passport or Birth Certificate or Domicile Certificate or SSC Board Certificate)
  • Bride & Bridegroom RESIDENTIAL proof (Ration Card or Passport or Election card or Electricity bill or Telephone bill of own name)
  • Photograph of both Bride and Bridegroom
  • All the above documents along with original + 1 attested copy
  • In case of Divorcees : Divorce Decree Certificate must be produced
  • In case of widow and widower : Municipal Death Certificate of concerned person must be produced

B) Under Section 16 of Special Marriage Act 1954.

  • Application to be made in the prescribed form duly signed by Husband & Wife.
  • Marriage should have taken any place in the India and both should be living together in Marriage Officer Jurisdiction.
  • Under U/s 16 of Special Marriage, Application should be given in 30 days advance.
  • Residential proof of both should be attached with application.

C) Marriage Memorandum Under Maharashtra Regulation Marriage Bureaus and Registration of Marriages 1998

1. Applicant has to submit the Memorandum of Marriage Forms ( which are supplied in the office of Marriage officer Mumbai.) affixed with Rs.100 court fee stamp.

2. Document to be attached :

  • Bride & Bridegroom Age proof: School / College Leaving Certificate OR Passport OR Birth Certificate OR Domicile Certificate OR PAN Card.
  • Bride & Bridegroom Residential Proof : Ration Card OR Passport OR Election Card OR Electricity Bill OR Telephone Bill of own name.
  • Three (3)Witness Proof :- Ration Card OR Passport OR Election Card OR Driving Licence OR Govt. Identity Card.
  • Wedding Card
  • In case of non availability of Wedding card Rs.100=00 Stamp Paper Affidavit of both husband wife and three witnesses is required
  • Rs.100=00/- Court Fee Stamp
  • Photographs of both Bridegroom / Bride

Note: 1. All above documents should be submitted along with Original + 1 Attested copy. The parties (Bride & Bridegroom) and Three witnesses to the marriage shall appear in person before the Registrar and sign a memorandum under section 6(B) of Maharashtra Marriage Act, 1998.
2. In case of Divorcees, Divorce Decree Certificate Must be produced.
3. In case of widow and widower Death Certificate of concerned person must be produced.
